Huawei sues US government over network equipment ban

The Chinese network equipment supplier Huawei is suing the United States government over the ban on government departments from buying Huawei equipment. The manufacturer claims there is no evidence to support the ban.

Huawei has filed suit in the Texas city of Plano, the company reports. The indictment focuses on Section 889 of the 2019 NDAA, the law that regulates the Defense budget. It states that government departments for important infrastructure are not allowed to purchase equipment from Huawei or ZTE.

Huawei calls that provision illegal because of two other legal provisions and claims it goes against the separation of powers because it allows the US Congress to make the law while trying to be the executive.

The Chinese manufacturer reiterates that it does not spy for the Chinese government, a position the company has often reiterated publicly. The US government has often expressed suspicions and other countries have also started to doubt the purchase of Huawei equipment for, for example, 5G networks. The United Kingdom and Germany, among others, would like to allow the purchase of Huawei equipment after previous doubts.
