GTX 970 users are suing Nvidia over performance issues

A class action lawsuit has been filed against Nvidia over the problems with the GTX 970. Customers want their money back because the video card does not perform as expected: that has to do with memory problems that recently came to light.

The lawsuit has been filed in the United States Northern District Court. The indictment, which has appeared online, shows that the prosecutors accuse Nvidia of misleading its customers. The documents filed with the court have appeared online. It concerns the GTX 970 video card that was introduced in September: it would not perform as well as advertised. This is a class action lawsuit that affected customers can join. The indictment also named Gigabyte as the producer of the GTX 970.

Earlier it was revealed that the GTX 970 suffers from memory problems: the last block of 0.5GB of vram performs significantly less well than the rest of the 4GB that is built into the card. Nvidia responded by stating that it is not that bad with the decline in performance. It then turned out that the GTX 970 has less rops than Nvidia had specified: according to the company, it is a communication error.

The indictment cites both the memory problems and the lower rops. The plaintiffs want to be compensated, which means that they want their purchase price back. Nvidia has not yet responded to the complaint.
