Facebook may continue to collect data in Germany

A German court has ruled that Facebook may continue to collect data from users in Germany. In February, the German watchdog Bundeskartellamt imposed restrictions, but the judge says they may be illegal.

The Düsseldorf court has serious doubts about the legality of the antitrust measures imposed by the German watchdog. That is the ruling in the appeal that Facebook brought against the measures announced in February.

According to the ruling, Facebook’s data collection may constitute a data protection violation, but that does not mean that Facebook is violating competition law. The measures announced by the Bundeskartellamt at the beginning of this year are based on Facebook’s dominant market position. The authority believes that Facebook is abusing its power by collecting data.

According to the Bundeskartellamt, Facebook must have explicit permission from users to combine data from accounts in Facebook, Instagram and WhatsApp. According to the authority, the collection of data via Like buttons on third-party websites is only allowed after explicit permission.

The ruling allows Facebook to continue collecting data from German users for the time being. The Bundeskartellamt does not agree with the statement and is going to appeal at the German Supreme Court.
