ICT lawyer Arnoud Engelfriet is now questioning Vodafone’s method of allowing unsolicited customer traffic to run through a proxy. Engelfriet suspects that Vodafone is thereby violating an article from the Telecom Act. “Well, maybe if you say ‘our network is so tight that we really have to reduce all images in size, otherwise the internet just won’t work’. That would make it legal, but from a marketing point of view that doesn’t seem like a useful position to take. “

That problem does not arise at Vodafone; the capacity of the network would currently be sufficient. Vodafone has not yet responded to Engelfriet’s claim and whether it has conducted an internal investigation into the legal basis for the proxy. Customers have been experiencing problems with the proxy for some time now. On Tuesday evening, Vodafone claimed it would be resolved.
