French Supreme Court: ‘Home copying is not a right’

The French Supreme Court has ruled that consumers have no right to make copies of DVDs for their own use. The ruling is the culmination of a case that was brought some time ago by a consumer who wanted to make a copy of his legally purchased DVD. That was not possible because the disc was protected with DRM, and the purchaser felt that this had unlawfully infringed his rights. The judge initially rejected his claim, but on appeal he was still right. The opposing party then appealed to the Supreme Court, which overturned the lower court’s decision. The court referred to the Berne Convention and the European Copyright Directive, which strongly restrict the right to private copies. The film and music industry are of course very satisfied with this statement. It is not yet known whether the consumer will appeal to the European Court.
